Probate & Family Court Awareness

Amendment XIV Section 1.

All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside. No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any state deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.

United Seniors of Oakland and Alameda County desires that all Seniors live out their Golden Years with freedom, peace and in harmony. If a Senior's choice is to continue living in their home they purchased, their wishes should be granted.

 

As long as a Senior is safe and cared for by family members or caregivers their freedom should not be hindered by a judicial system which infringes upon their independence.

 

Probate & Family Courts nationwide have dominated in the decision-making process for the elderly. Seniors have been robbed of their assets, their homes have been sold, and they have been placed against their wishes in nursing homes or residential care facilities, which depresses them and shortens their life span. 

 

Once the Probate Court is involved, family members have been disregarded, as decision-makers for their loved ones. All assets are usually placed in the hands of the Court Appointed Officials and generational wealth gets stunted and controlled by others rather than the family.

 

Advocate Venus Gist met Alameda County Board of Supervisor Nate Miley at a public screening of the documentary film, The Guardians by filmmaker Billie Mintz. Supervisor Miley has been raising awareness since watching the film.

 

USOAC Member & Care Advocate/Consultant Venus Gist experienced predatory actions against her family by the Alameda County Probate, Berkeley Court. This was the beginning of her Advocacy.

 

Our goal at USOAC is to bring awareness and educate seniors, families and the community on preventative methods to avoid Probate Court interactions. We ask that judges, attorneys, guardians & conservators follow the laws that have been established to give wards of the courts, their rights to choose freely and to live independently with family

members who love and care for them, during their Golden Years.
